403 Mr. Gogarty asked the Minister for the Environment Heritage and Local Government if he has issued the commencement order on section 261 of the Planning and Development Act 2000; if not, the reason therefor; and if he will make a statement on the matter. [17495/03]

My Department is currently preparing detailed guidance for the assistance of planning authorities on the implementation of section 261 of the Planning and Development Act 2000. It is intended to com mence this section of the Act following the publication of this guidance in the autumn.
