I have contacted the Garda authorities for the information requested by the Deputy. Regrettably, this information was not available in time and I will write to the Deputy directly when it is to hand.
The following deferred reply was received under Standing Order 51.
I refer to Parliamentary Question No.191 of 10 July 2024 where you sought: “To ask the Minister for Justice the numbers who have availed of adult diversion programme in 2024.”
As you will recall, I sought the information from the Garda authorities and undertook to contact you again once the information was to hand.
As you will be aware, the Adult Caution Scheme is a non-statutory scheme agreed between, and administered by, An Garda Síochána and the Director of Public Prosecutions. Both the Garda Commissioner and the Director of Public Prosecutions are independent in their functions and I, as Minister, have no role in the setting of criteria used when administering the Scheme.
However, I am advised that the Garda Authorities have published the policy documentation relating to the Scheme at the following link on the Garda website:
www.garda.ie/en/about-us/publications/policy-documents/adult-cautioning-scheme-policy-document-feb-21-.pdf
To be of assistance, I have contacted the Garda authorities and have been advised that, there have been a total of 3,450 Adult Cautions issued.
I am advised that counts of Adult Cautions are based on date of administration and the above relates to those administered between 1 January 2024 and 9 July 2024. This information was collated based on PULSE data as of 1:30am on 10 July 2024.
Please note that this information is based on operational data and may be liable to change.
I trust this information is of assistance.
