Deputy David Cullinane asked the Minister for Health the total cost of medical negligence litigation against the HSE and Department of Health in each year from 2010 to date, including awards made in the courts, settlements made out of court to resolve disputes, and legal costs, in tabular form [30318/24]

The State Claims Agency (SCA) has a statutory remit to manage personal injury claims on behalf of State Authorities including the Health Service Executive. The SCA has provided me with the information contained within this document and has informed me that the information was extracted from the National Incident Management System (NIMS) as per the below criteria.

The following table contains the transactional amounts paid (including VAT where applicable) under the clinical indemnity scheme, that are associated with claims and a small number of incidents and inquests. This includes claims recorded by the SCA across hospitals, nursing homes, HSE locations including community healthcare locations, and COVID-19 response locations. It excludes claims recorded against other designated schemes. It includes payments between 01/01/2010 and 30/06/2024 and is correct as of 01/07/2024.
