Deputy Peadar Tóibín asked the Minister for Enterprise, Trade and Employment the number of legal cases taken against his Department in each of the past ten years and to date in 2024; the costs incurred by his Department in relation to such cases; and if he will make a statement on the matter. With regard to the number of legal cases taken against my Department, the table below is compiled based on records available and sets out the number of cases commenced against the Department over the past ten years and up to September 2024. Cases do not always fall into one calendar year, and in some cases, they may run over a number of years.

Regarding cases which are in relation to provisions of the Protection of Employees (Employer’s Insolvency) Act 1984, responsibility for this Act transferred to the Minister for Enterprise, Trade and Employment from the Minister for Social Protection in October 2020. Therefore, legal cases prior to October 2020 were initiated against the Minister for Social Protection, but are now reported by the Department of Enterprise, Trade and Employment. These cases are set out in the table below:
