Deputy Paul Murphy asked the Minister for Public Expenditure, Infrastructure, Public Service Reform and Digitalisation the way in which the Information Commissioner maintains his independence under section 43(3) of the Freedom of Information Act 2014 when both training and reviewing the self-same public bodies. 329. Deputy Paul Murphy asked the Minister for Public Expenditure, Infrastructure, Public Service Reform and Digitalisation the way in which the Information Commissioner justifies wasting his experienced staff's time and effort to develop and deliver training modules for public bodies when he only closed 51% of cases in 2023 within the four months stipulated at section 22(3) of the Freedom of Information Act 2014. I propose to take Questions Nos. 330 and 329 together.

This is a matter for the Information Commissioner to answer, as the Information Commissioner is independent in the performance of his function as a matter of law and in practice.  Section 43(3) of the Freedom of Information Act, 2014 refers.

The Commissioner has indicated that he is happy to engage directly and will provide a response on the matters raised.
