Deputy Tom Brabazon asked the Minister for Transport the passenger-protection mechanisms which currently exist under the NTA for non-fault incidents; if the NTA provides any guidance to operators; and if his Department will consider examining a limited safety-net mechanism as part of the ongoing review linked to the MIBI. As Minister of State for International & Road Transport, Logistics, Rail & Ports, I wish to advise that I have responsibility for policy and overall funding in relation to public transport. However, I am not involved in the day-to-day operations of public transport.

The National Transport Authority has statutory responsibility for the provision of public passenger transport services nationally, in conjunction with the relevant transport operators. Accordingly, I have forwarded the Deputy's questions in this area to the Authority for direct reply. Please advise my private office if you do not receive a response within ten working days.

The legal vires held by my Department with regard to motor insurance primarily concern the requirement under European law and under the Road Traffic Acts for the driver of a vehicle to hold valid third party cover. The principal role of the Motor Insurers' Bureau of Ireland (MIBI) is to compensate victims of road traffic accidents caused by uninsured or unidentified vehicles. I do not intend to extend the Bureau's role to incidents involving insured vehicles.
