I am not aware of the legal advice provided to the Approved Housing Body (AHB) concerned and as such, it would not be appropriate for me to comment on the circumstances preventing them from continuing to provide the property management service.

In multi-unit developments, the property management agent is engaged by the Directors of the Owners’ Management Company (OMC) to provide a property service to that OMC. The OMC engages with the Property Management agent on behalf of homeowners. The Multi-Unit Developments Act 2011 (MUDs Act) facilitates the fair, efficient and effective management of OMCs.

At present, the Minister for Justice, Home Affairs and Migration and his Department continues to have responsibility for the MUDS Act and the oversight of OMCs and related regulations.
