Deputy Paul Lawless asked the Minister for Transport the rationale for the current system under which penalty points are applied from the date on which they are formally processed and imposed by the national vehicle and driver file, rather than the date on which the motorist receives the fixed-charge notice; if he is aware that this results in penalty points remaining active for a period longer than the three years widely understood by motorists; and if he will make a statement on the matter. As Minister of State with responsibility for International & Road Transport, Logistics, Rail & Ports, I wish to clarify that section 7 of the Road Traffic Act 2002 specifically requires that penalty points come into effect on a driver's licence 28 days after the driver has been notified of the points by my Department. The purpose of this provision is to allow drivers adequate time to put any necessary logistical, employment or childcare transport arrangements in place before the points take effect, particularly in circumstances where those points will trigger a full disqualification from driving.

The penalty point notice letter received by the driver clearly communicates the date on which the points come into effect, as set out above, and the fact that the three year duration of those points will count down from that date. It is not the case that any driver would have penalty points on their licence for longer than the three years specified by the Act.
