94. Deputy Emer Currie asked the Minister for Education and Youth to provide details of the number of legal actions against her Department that have been resolved without going to court in line with the 2023 State Litigation Principles; if her Department is fully applying the State Litigation Principles in seeking to resolve any current or outstanding legal actions; and if she will make a statement on the matter. My Department adheres to the State Litigation Principles and the standards they articulate in its conduct of legal proceedings, including those proceedings which are resolved without a final court hearing.

Since January 2025, my Department has resolved 74 legal actions (being litigation which had commenced) without a final court hearing, in line with the State Litigation Principles.

This figure does not include those cases which are currently moot save as to costs or litigation that has been managed by the State Claims Agency, which has delegated authority pursuant to the National Treasury Management Agency Acts 1990 to 2014 to manage personal injury and third-party property damage claims against the Department.
