698. Deputy Mairéad Farrell asked the Minister for Agriculture, Food and the Marine the reason that applications for a public sector job (details supplied) are restricted to employees already working in the public sector; and if he will make a statement on the matter. [33210/26]

I wish to inform the Deputy that the Agriculture Appeals Office operates independently of my Department.

The Agriculture Appeals Office was established under legislation. It was established to consider and adjudicate on appeals from farmers dissatisfied with decisions taken in respect of their entitlements under farm schemes administered by the Department of Agriculture, Food and the Marine.

The Agriculture Appeals Act 2001 (Section 3) confines the appointment to the position of Director of Agriculture Appeals to a person holding a position within the Civil Service.

I am satisfied that the appointment of the Director is in accordance with the relevant legislation.
