780. Deputy Cathal Crowe asked the Minister for Housing, Local Government and Heritage to detail the role of his Department and role of the NSAI in interpreting building regulations and standards; the final arbiter of interpreting regulations and guidance; and if he will make a statement on the matter. The design and construction of buildings is regulated under the Building Control Acts 1990 to 2025 in order to ensure the safety of people within the built environment. The Acts provide for the making of Building Regulations, Building Control Regulations and also set out the legislative basis for the system of enforcement.

The primary responsibility for compliance with the requirements of the Building Regulations rests with the designers, builders and owners of buildings. Enforcement of the Building Regulations is delegated under the Building Control Acts 1990 to 2025, to the local building control authorities (i.e. the 31 local authorities) who are independent in the exercise of their statutory powers. My Department has no function in assessing whether any particular works comply with the Building Regulations. Interpretation of the legislation is ultimately a matter for the Courts.

The Building Regulations 1997, as amended, set out the legal requirements in Ireland for the construction of new buildings (including houses), extensions to existing buildings as well as for material alterations and certain material changes of use to existing buildings. The related Technical Guidance Documents (Parts A - M respectively) provide technical guidance on how to comply with the regulations in practical terms and often refer to European and Irish Standards. Where works are carried out in accordance with the relevant technical guidance, such works are considered to be, prima facie, in compliance with the relevant regulation(s). The Building Regulations are set out in functional terms.

The National Standards Authority of Ireland (NSAI) is Ireland’s official standards body and is an autonomous body under the aegis of the Minister for Enterprise, Tourism and Employment.
