Deputy Marie Sherlock asked the Minister for Justice, Home Affairs and Migration if he accepts that the continuing failure to commence the Court Proceedings (Delays) Act 2024 risks depriving persons affected by excessive court delay of the very remedy established by the Oireachtas two years ago and for him to account for the delays in recruiting the necessary staff to enforce the legislation. The Court Proceedings (Delays) Act 2024 provides parties with a right to conclusion of proceedings within a reasonable time and for compensation where that right is breached, via an independent assessment process.
Arrangements to operationalise the requirements of the Act are currently being finalised with a view to the Act being commenced shortly.
An important step in operationalising the Act is the recruitment process for personnel necessary to give effect to the Act. That process is at an advanced stage (including the posts of Chief Assessor and Court Delays Assessors, recently advertised through the public appointments service). As Minister, I look forward to seeing that process concluding soon, with the necessary appointments made thereafter.
