Deputy Cian O'Callaghan asked the Minister for Children, Disability and Equality the legal basis for Tusla's interpretation of section 66 of the Child Care Act 1991 regarding superannuation eligibility for staff employed in children's residential and aftercare services listed in S.I. 124/1992, 125/1992 and 863/2004; if her Department has issued any guidance or determination limiting eligibility (details supplied) to staff; and if long standing scheme members can legally be removed from this superannuation scheme based on an interpretation not provided for in primary legislation.
