Written Answers. - National Lottery Funding.

Ceist:

289 Mr. S. Ryan asked the Minister for Arts, Sport and Tourism if an agreement has been reached between his Department and Fingal County Council with regard to a deed of trust to be signed by clubs and organisations which secure lottery grants and which propose to provide their project on local authority lands; and if so, when the amended deed will be approved and signed by the Chief State Solicitor's office. The national lottery-funded sports capital programme, which is administered by my Department, allocates funding to sporting and community organisations at local, regional and national level throughout the country.

One of the conditions of grant payments, where the recipient has been provisionally allocated funding of more than €80,000, is the execution of a legal deed which provides,inter alia, for a refund of the grant in the event of the facility not continuing to be used for the purpose for which the grant was allocated. My Department's legal advisers, the Chief State Solicitor's office, invoked this deed of covenant and charge. The requirement for such a deed is standard practice in terms of state funding and also applies under the ACCESS programme for arts facilities which is administered by my Department.
Recently, Fingal County Council, which is required to sign this deed of covenant and charge in cases where the grant recipients do not own the site for the project but rather operate under licence from Fingal County Council, has raised issues of concern to them around these deeds with my Department. Officials of my Department have been in contact with both the local authority and the CSSO with a view to dealing with these issues. Discussions are ongoing, which I hope will result in a mutually acceptable agreement in the very near future.
