1129. Deputy Carol Nolan asked the Minister for Justice the number of notifications of intention to deport issued under section 3 of the Immigration Act 1999 (as amended) for each year from 2001 to date, in tabular form; and if she will make a statement on the matter. [1690/24]

It has not been possible to collate the information requested in the time allowed. I will write to the Deputy directly when the information is to hand. 

The following deferred reply was received under Standing Order 51.
I refer to your Parliamentary Question No. 1129 which was for answer on 17 January 2024 and which asked: “…the number of notifications of intention to deport issued under section 3 of the Immigration Act 1999 (as amended) for each year from 2001 to date, in tabular form; and if she will make a statement on the matter.”
You will recall that at the time, I undertook to seek the information requested and revert to you.
With apologies for the delay in issuing a further response, I can now confirm that where a person no longer has permission to be in the State they are notified of the intention to make a Deportation Order in respect of them. They are further advised of their options and that they should respond to this letter within 15 days.
They have the following 3 options.
1. Voluntary return. In this case assistance is provided to leave the State and no Deportation Order is issued.
2. Consent to a Deportation Order.
3. The person may submit representations under Section 3 (6) of the Immigration Act 1999 (as amended) detailing why a Deportation Order should not be made in respect of them. If this is successful no Deportation Order is issued and the person is given “Leave to Remain” for a specific period.
The following table details the number of notifications of intention to deport issued under section 3 of the Immigration Act 1999 (as amended)
Electronic records are available since 2013 of persons who have been issued with an intention to deport under section 3 of the Immigration Act 1999 (as amended). The numbers are outlined in the table below:
