For the purposes of Bereaved Partner's Contributory Pension, a person will be considered a qualified cohabitant, if the applicant lived with the deceased as a cohabiting couple, in an intimate and committed relationship for two years, where there are children of the relationship; or five years where there are no children of the relationship.

In determining whether a person is a qualified cohabitant, the circumstances of the relationship are taken into account, having regard to, but not limited to, the duration of the relationship, the basis on which the couple lived together, the degree of financial dependence of either adult on the other etc.

Having reviewed the facts presented with the initial application of the person concerned, their claim was disallowed as the information provided did not support a finding they were a qualified cohabitant.

On receipt of further supporting documentation from the Deputy, the application was reviewed and has been awarded. The person concerned is being notified in writing of the revised decision.

I trust this clarifies the matter for the Deputy.
