The Artist’s Resale Right (ARR) was introduced into Irish law through S.I. No. 312/2006 – European Communities (Artist’s Resale Right) Regulations 2006, which transposed EU Directive 2001/84/EC on the resale right for the benefit of the author of an original work of art. It was amended by S.I. No. 709/2011 and S.I. No. 375/2022.
This legislation prescribes the conditions under which ARR applies. Whilst the monetary threshold contained within this legislation is determined at national discretion, we recognise that Ireland currently operates at the maximum permissible level provided for under the Directive.
However, at present, there are no plans to reduce the threshold applicable under Irish law.
