Deputy Cathal Crowe asked the Minister for Education and Youth the protocols and funding available through the emergency works scheme to support schools where prefabricated buildings suffer sudden and unforeseen damage; if she will clarify the specific criteria for 'immediate risk to health, life, property or the environment' as it pertains to aging modular units; and if she will make a statement on the matter. As the Deputy may be aware, the purpose of the Emergency Works Scheme (EWS) is to provide funding specifically for unforeseen emergencies, or to provide funding to facilitate inclusion and access for pupils with special needs. It does so by ensuring the availability of funding for urgent works to those schools that are in need of resources as a result of an emergency situation.

An emergency is deemed to be a situation which poses an immediate risk to health, life, property or the environment, which is sudden, unforeseen and requires immediate action, and in the case of a school, if not corrected would prevent the school or part thereof from opening.

The EWS operates on the basis of a minimal scope works to address the emergency situation. The EWS is intended to remedy an emergency situation and usually provides only an interim measure until a permanent solution can be delivered under the Summer Works Scheme (SWS) which deals with upgrade works to the school.

The EWS is open to schools with permanent recognition and in non-rented accommodation. Applications are considered on a case-by-case basis having regard to the nature and extent of the issue identified and the supporting professional reports submitted by the school authority.

To support an application, schools are generally required to submit independent professional assessment reports, including photographic evidence and cost estimates, clearly outlining information such as;

• the nature of the defect or damage;

• why the issue is considered sudden and unforeseen;

• the risks posed to occupants, property or the environment

• why immediate remedial action is necessary. and

• proposed solutions

The Department assesses each application in line with the terms of the Emergency Works Scheme, Circular Letter 0068/2020.

Where works relate to deterioration associated with the age or general condition of accommodation, these may not fall within the scope of the scheme unless there is evidence of an immediate and significant risk requiring urgent intervention.

My Department will continue to engage with schools to ensure that emergency health and safety issues are addressed as quickly as possible.
