7. Deputy Donna McGettigan asked the Minister for Climate, Energy and the Environment to reassure the people of Clare that international investor courts in CETA cannot be utilised by companies in relation to prospecting or mining in County Clare. [69289/26]

It should be noted that at present Ireland has not ratified the EU-Canada Comprehensive Economic and Trade Agreement (CETA).

Investment protection afforded under CETA can only be invoked strictly in accordance with the criteria contained therein, and furthermore, can only be enforced subject to the commencement of the Arbitration (Amendment) Act 2026, and also subject to the consent of the High Court in Ireland.

However, I have been advised that Article 8.10 of CETA does not restrict/impact the seeking of remedies before domestic courts.
