476. Deputy Donna McGettigan asked the Minister for Education and Youth the reason a teacher (details supplied) has been employed on fixed-term contracts even though, under current legislation, a teacher must typically complete two consecutive years of employment with the same employer to secure a contract of indefinite duration (CID); the action she will take to ensure teachers can get a CID; what this teacher must do to secure a CID; and if she will make a statement on the matter. The provisions of Circular 23/15 (Primary) and 24/15 (Post-Primary) set out the criteria for the award of a Contract of Indefinite Duration (CID) to teachers.

Department Circulars 20/26 and 21/26 revise Circulars 23/15 and 24/15 to reduce the length of time for a teacher to qualify for the award of a CID from a period of two years continuous service to a period of 1 year continuous service, subject to satisfying the criteria set out in the Circulars.

In order for a school to award a CID, the teacher must satisfy the criteria set out in the circulars and a viable post must be available in the school.

Under the provisions of Circular 30/2018, where a teacher has been employed on a fixed term contract and they believe they fall within the terms of the circulars or are unhappy with the action taken by their employer in terms of the award of a CID, the teacher may appeal against the action of their employer, subject to the time limits set out in the Circular.
