I propose to take Questions Nos. 459, 460 and 461 together.

As set out in the Programme for Government, it is our intention within the life-time of this Government to expand GP care without charges to all children up to the age of at least 12 years. This will be done in a planned way, in cooperation with GPs to ensure that there is adequate capacity in place.

The outcome of the Strategic Review of General Practice will be a key factor in enabling the expansion of GP care without charges. Work on the review has been ongoing, and significant progress has been made, with the report to be completed this year.

Discussions relating to the 2027 Estimates process are currently underway and will not be concluded until closer to the date of the Budget.

Under the Provision of the Public Service Agreement 2024 – 2026, the Local Bargaining process is the mechanism under which all cost increasing claims are to be resolved.

The Department of Health has been working positively with HSE colleagues and Trade Unions to progress claims under the auspices of this process.

Progress has been made for numerous claims and the work is ongoing and is expected to be completed in the coming months.

Deputy Pádraig Rice asked the Minister for Health if her attention has been drawn to any other breaches of the public only consultant contract within other specialities other than obstetrics in the Rotunda Maternity Hospital; if so, to identify the specialities and the nature of the breaches; the engagement she has had with the Rotunda Maternity Hospital about such breaches; the enforcement action taken; and if she will make a statement on the matter. Public Only Consultant Contract (POCC) holders are not permitted to engage in private practice within public hospitals. This position is unequivocal. There are no exemptions, arrangements or deviations from the terms of the contract. It has emerged that some private consultants specialising in Obstetrics and Gynaecology at Cork University Maternity Hospital have also been making payments or “gifts” to public consultants for covering their clinical duties related to pregnancy care.

Any suggestion of private financial arrangements in this context would be inconsistent with contractual obligations, would raise serious concerns, and risks diverting time and resources away from treating public patients. Ensuring equitable access to high-quality care based on need, not ability to pay, is a core objective of Sláintecare. Separately, any tax compliance issues arising from payments linked to work or the provision of services would be a matter for Revenue.

It is the Minister’s expectation that all hospitals and all consultants are fully compliant with the terms of the contract. Where deviations have been identified, the Minister has been clear that immediate action must be taken by the HSE to ensure full compliance.
